Your access to and use of the website https://www.Recutel.com is governed by these Terms of Use. By using this website, you acknowledge that you have read and accept these terms of use. These terms are subject to change at any time.
2. Personal Data
The Company is committed to an ongoing process of protecting its Users' personal data, and strives to maintain its strict confidentiality, in accordance with the provisions of Law No. 78-17 of January 6, 1978, amended by Law No. 2004-801 of August 6, 2004, relating to information technology, files, and civil liberties (the "Data Protection Act"), and Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of data (the "GDPR").
In application of the Data Protection Act and the GDPR, it is recalled that the personal data requested from the Seller for the creation of his member account, access to the Services and the smooth running of the sale, are necessary for the processing of his order and the establishment of invoices, in particular.
The Company's policy regarding the management of personal data is detailed in Article 4 of the General Terms and Conditions, accepted by the Seller when creating his member account on the Site, and of which he declares to be aware. The parties will refer to these provisions for any questions relating to the protection of personal data entrusted by the Seller to the Company.
3. Intellectual property rights
The images, texts, logos, photos, databases, names, icons and any other elements of this site are the exclusive property of the Recutel company, except for the brands of manufacturers and partners, or content belonging to other companies that have subscribed to the Recutel offer.
It is prohibited to reproduce, modify, publish, distribute, transmit or sell the content of this site without the agreement of Recutel.

4. Trade-in
a) Trade-in prices
Recutel guarantees trade-in prices for fourteen (14) days from the date of the transfer receipt. The product must be collected or received before the 14th day. After fourteen (14) days, prices are subject to downward adjustment.
b) Administrative dispute(s)
The customer must legally provide a copy of their ID if shipping the product or an official document upon collection.
Any missing or invalid documents will be reported to the customer.
The customer may send the missing and/or valid documents by email.
Two reminders will be sent to the customer within 30 days. If the customer does not respond to these two (2) reminders, the product will be placed in quarantine and will not be paid for.
After six (6) months, without response or intervention from the customer, the product will no longer be paid for and will automatically become the property of Recutel.
c) Product Dispute(s)
When answering the online diagnostic questions, the customer must be as honest and vigilant as possible.
Recutel, for its part, must, upon receipt of the product, check the supporting documents provided (signed transfer slip and valid identity document), check the condition of the product and the accuracy of the condition of the product sent by the customer.
If one or more discrepancies are revealed between the customer's diagnosis and the technical tests, a counter-proposal email is sent, reporting the dispute(s) inherent to the product.
If the customer responds to the counter-offer email within 7 days:
The customer has the option to accept or reject this counter-offer.
The customer must respond to this counter-offer within a maximum of 7 days.
If the customer accepts the counter-offer, Recutel will process the payment by bank transfer within 7 days.
If the customer rejects the counter-offer, the customer must then retrieve the product at Two reminders will be sent to the customer within 30 days. If the customer does not respond to these two (2) reminders, the product will be placed in quarantine and will not be paid for. After six (6) months, without a response or customer intervention, the product will no longer be paid for and will automatically become the property of Recutel.
If the customer responds beyond thirty (30) days to the counter-proposal email:
The repurchase price will be changed downwards and will be the subject of a counter-offer at the current Argus price.
If the customer accepts the counter-proposal, Recutel will proceed with payment by transfer within 7 days.
If the customer refuses the counter-offer, the customer must then recover the product at his own expense by following the procedure sent to him by email.
Two reminders will be sent to the customer within 30 days. If the customer does not respond to these two reminders, the product will be placed in quarantine and will not be paid for. After six (6) months, without response or intervention from the customer, the product will no longer be paid for and will automatically become the property of Recutel.
d) Product processing/approval
Recutel has legal obligations to:
- to approve products in compliance with current corporate social responsibility standards
- to erase all customer data present in the product during technical tests.
- to recycle the product when it is not recoverable or no longer has any value after the technical test.
Recutel must test and approve the transaction received within three (3) working days of receipt of the product.
e) Payment for the product
As soon as the transaction is compliant or the counter-proposal validated by the Customer within seven (7) Days, Recutel must issue a transfer of the amount to the customer's account within a maximum of seven (7) days.
f) Transfer of ownership
The transfer of ownership is made directly from the customer to Recutel.
g) Disputes
The parties will endeavor to amicably resolve any dispute as well as any complaint submitted to the Company's customer service department.

In the absence of an amicable resolution, the dispute will be brought before the competent courts in the jurisdiction of the defendant's domicile or the place of delivery of the Product, in accordance with the rules of common law.
5. Responsibilities
Recutel may contain advertising links to other sites on the Internet. These other sites are not under the control of Recutel.
Recutel is not responsible for the accuracy, copyright compliance, legality, decency, or any other aspect of the content of such sites. The inclusion of such a link does not imply any endorsement by Recutel or any association with its operators.
Recutel uses all reasonable means at its disposal to ensure quality access to the site, but is under no obligation to do so. Recutel reserves the right to interrupt, suspend or modify access to all or part of the site without notice, in order to ensure maintenance, or for any other reason, without the interruption giving rise to any obligation or compensation.
